BuildCode provides custom web design and development services across three tiers: Beginner, Standard, and PRO. The specific scope, deliverables, and price for each project are confirmed in writing (via email or project agreement) before work begins. Any features or pages not explicitly included in the agreed scope are considered out of scope and may incur additional charges.
A non-refundable deposit of 50% of the total project fee is required before work commences. The remaining 50% is due upon project completion, before the final files or live deployment are handed over. Invoices are issued in Australian Dollars (AUD). Payments not received within 14 days of the invoice date may result in work being paused. BuildCode reserves the right to charge interest on overdue amounts at 2% per month.
Each package includes a set number of revision rounds: Beginner (1 round), Standard (2 rounds), PRO (3 rounds). A revision round means a consolidated set of changes submitted at one time. Additional revision rounds outside the agreed scope may be billed at an hourly rate of $120 AUD per hour. Major scope changes are billed as follows: text or image updates ($80 AUD), new sections ($250 AUD), new pages ($600 AUD). Alternatively, clients may purchase a prepaid hour pack (3 hrs/$360, 6 hrs/$660, 10 hrs/$1,000 AUD) valid for 6 months.
The client is responsible for providing all required content (text, images, logos, brand guidelines) in a timely manner. Delays caused by late content delivery may extend the project timeline without liability to BuildCode. The client warrants that any content provided does not infringe the intellectual property rights of any third party. BuildCode is not responsible for sourcing, licensing, or verifying third-party content provided by the client.
Upon receipt of final payment, the client owns the website code and all custom assets created specifically for their project. BuildCode retains the right to display the completed work in its portfolio and marketing materials unless the client requests otherwise in writing. Any third-party libraries, plugins, or stock assets used in the project remain subject to their respective licences.
Estimated delivery timelines (Beginner ~2 weeks, Standard ~3–4 weeks, PRO ~6–8 weeks) are guides only and begin from the date the deposit is received and all required content is provided. BuildCode will communicate any delays as soon as reasonably possible. BuildCode is not liable for delays caused by third-party services, client response times, or circumstances beyond its control.
BuildCode deploys websites to Vercel (syd1 region). Hosting costs are not included in the project price and are the client's responsibility. After handover, ongoing maintenance, updates, and support are not included unless a separate support arrangement is in place. Clients may request ad-hoc changes at any time under the fixed-price or on-demand rates described in Clause 3. BuildCode is not liable for website downtime, performance issues, or security breaches after the project handover date.
If the client cancels a project after work has commenced, the deposit is non-refundable. If BuildCode cancels the project for reasons not attributable to the client, a pro-rated refund of the deposit will be issued based on work completed. Either party may terminate the agreement with 7 days written notice if the other party is in material breach and fails to remedy the breach within that period.
BuildCode's total liability to the client for any claim arising under these Terms shall not exceed the total fees paid by the client for the relevant project. BuildCode is not liable for any indirect, consequential, incidental, or special damages, including but not limited to loss of revenue, loss of data, or loss of business opportunity. Nothing in these Terms limits liability for fraud or any other liability that cannot be excluded by law.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
BuildCode reserves the right to update these Terms at any time. Updated Terms will be published on this page with a revised effective date. Continued use of BuildCode's services after changes are published constitutes acceptance of the updated Terms.
